Sub: MACP Scheme for Railway Servants-treatment of employees selected under LDCE/GDCEClarification reg.

References have been received from Zonal Railways seeking clarification regarding grant of benefits under MACPS in respect of the employees qualifying through LDCE/GDCE. The matter has been examined in consultation with Department of Personnel & Training (DoP&T), the nodal department of Government on MACPS and it has been decided as under:

(i) If the relevant RRs provide for filling up of vacancies in a grade by Direct Recruitment, induction of an employee to that grade through LDCE/GDCE may be treated as Direct Recruitment for the purpose of grant of financial upgradation under MACPS. In such cases past service rendered in a lower pay scale/Grade Pay shall NOT be counted for the purpose of MACP Scheme.

(ii) if the relevant RRs prescribe a promotion Quota to be filled on the basis of LDCE/GDCE, such appointment would be treated as promotion for the purpose of benefit under the MACPS and in such cases, past regular service shall also be counted for further benefits, if any, under the MACP Scheme.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub:-Grant of financial upgradation under MACP Scheme-Clarification reg.

References have been received from Zonal Railways seeking clarification as to what Grade Pay would be admissible under MACP Scheme to an employee holding feeder post in a cadre where promotional post is in the same Grade Pay. The matter has been examined in consultation with Department of Personnel & Training (DoP&T), the nodal department of the Government on MACP Scheme and it is clarified that ACP/MACP Schemes have been introduced by the Government in order to mitigate the problems of genuine stagnation faced by employees due to lack of promotional avenues.

Thus, financial upgradations under ACP/MACP Schemes CANNOT be to higher Grade Pay than what are be allowed to an employee on his normal promotion. In such cases financial upgradation under MACP Scheme would be granted to the same Grade Pay.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Calculation of Gratuity


Calculation of Gratuity

Service Gratutiy
·         When a Railway Employee has rendered service less than 10 years no pension shall be paid.
·         Service Gratutiy will be paid at the rate of one month emoluments for each completed year of   service.
·         No reduction will be made whether the retirement of the Railway Employee is on medical grounds or personal grounds.
·         Emoluments means basic pay(ie, pay in Pay Band plus applicable Grade Pay) plus NPA if any and DA admissible on the date of retirement.

Retirement Gratuity
·         When a Railway Employeehas rendered minimum qualifying service of 5 years Retirement Gratuity is paid at the rate of 1/4th of one month’s pay per each completed half year of service subject to a maximum of 161/2 month’s pay or 10 Lakh rupees whichever is less.

Death Gratuity
Paid in case of death of a Railway Employee while in service at the following rates.

Less than 1 year
2 times emoluments
One year or more but less than 5 years
6 times emoluments
5 years or more but less than 20 years
12 times emoluments
20 years of more
Half of emoluments for every completed 6 monthly period subject to maximum 33 times emoluments subject to maximum limit of Rs. 10 Lakh.

Terminal Gratuity

5 years or more but less than 10 years
Half month pay for each completed year of service
10 years or more but less than 20 years
One month pay for each completed year of service subject to maximum limit of Rs. 150000 or 15 months pay whichever is less.

Basic Pension/settlement

·         Basic Pension is calculated as the last month emoluments or average of last 10 month emoluments which is higher. Normally higher of this will be last month emoluments unless the employees Pay was reduced in last months due to a punishment etc.

Emoluments
      ·         For Doctors - Basic Pay(Pay + GP) plus NPA(Non Practicing Allowance)

      ·         For other employees - Basic Pay(Pay + GP)

·         For Railway Running staff (Loco Pilots, Asst Loco Pilot, Guards) 55% of Basic Pay is added to the basic pay for all pension calculations.

Details of an employee retiring on 31-3-2012 is as follows:

Imagining that the Railway servant in question didn’t get a pay reduction in the last 10 months,

·         His emoluments will be equal to Last Basic Pay(Pay + GP) = Rs. 25000

·         His Basic Pension ( 50% of emoluments ) = Rs. 12500/-

Now he has two options:

Option 1 : He doesn’t opt for commutation.

·         If the employee doesn’t opt for Commutation he has get the Basic Pension Rs. 12500 plus applicable DR(Dearness Relief) on this(65% from 1.1.2012)

Option 2 : He opt for commutation

·         Maximum 40% of the Basic Pension can be commuted.

·         Commutation amount = Age factor x 12 x (40% of Basic Pension) = 8.194 x 12 x (40% of 12500) = Rs. 4,91,640

·         (No DA/DR is paid on this and hence DR will be paid on the full Pension amount monthly)

·         Now for the first 15 years the employee get the remaining amount pension ie, 60% of 12500 = Rs.7500 (plus DR calculated on full pension or Rs. 12500).

·         After the expiry of 15 years the employee gets full pension as that in Option 1

Gratuity

·         Gratuity is calculated as half month emoluments for every completed year of service subject to a maximum of 33 years.

·         Minimum 5 years service is needed for payment of Gratuity.

Emoluments for purpose of Gratuity

·         For Doctors : (Pay + GP +NPA )+ DA

·         For other employees :(Pay + GP) + DA

·         For Running Staff : (Pay + GP + 55% as Pay element of Running staff) + DA

·         Maximum of amount of Gratuity will be 10 Lakhs.

In the illustration above,

·         Service is 35 years, but maximum is 33 yrs.

·         Emoluments (for this purpose includes DA also) = 20400 + 4600 + (65% of 25000) = 41250

·         Hence Gratuity = 16 ½ * 41250 = Rs.6,80,625

Leave encashment

·         Leave encashment upto 300 days (both LAP and LHAP combined) is permitted.

·         The above employee has 250 LAP and 198 LHAP.

·         So in his case 250 LAP and 50 LHAP (total 300) will be encashed.

·         Encashed amount of LAP (for 250 LAP) = (Pay + GP + DA applicable) / 30 * LAP at credit = (20400 + 4600 + 16250) /30 x 250 = Rs. 3,43,750 /-

·         Encashed amount of LHAP (for 50 LHAP) = (Pay + GP DA applicable) /2/ 30 * LHAP at credit (subj to overall limit of 300) = (20400 + 4600 + 16250) /2/ 30 x 50 = Rs. 34,375 /-

·         Total amount of leave encashment = Rs. 2,29,166 /-

Provident Fund

·         Balance at the credit of employee’s SRPF is paid at the time of his retirement along with interest accrued.

Final settlement money for the above employee

·         Pension commuted = Rs. 4,91,640

·         Gratuity = Rs.6,80,625

·         Leave encashment = Rs. 2,29,166

·         PF Balance = Rs.1,02,345

·         Total settlement amount = Rs. 15,03,776 /-

HOER Rules for Running Staff

  • Loco and Traffic Running staff even though classified as Continuous will be required to be on duty more than 8 hours at a stretch in view of special nature of their duties.
  • Overall duty at a stretch of Running staff from signing On to Signing off should not normally exceed 12 hours and they should be entitled to claim relief thereafter.
  • Running duty at a stretch should not normally exceed 10 hours from departure of train and staff are entitled to claim rest thereafter.
  • In operational exigencies running duty may be extended beyond 10 hours within overall limit of 12 hours provided a due notice has been given to staff by Section Controller before completion of 8 hours of running duty.
  • If a train doens not reach within overall limit of 12 hours its normal crew chaning station/destination of the train or where a relief has been arranged and such point is approximately 1 hour journey staff may be required to work upto that point.
  • In exceptional emergencies like accidents staff may be required to work beyond the limits prescribed above. In such cases Controller should advise the staff in advance.
  • Undermentioned period will count as duty under 10 hour rule:
  • (i) Engine attendance time as prescribed.
  • (ii) Time taken from starting station to crew changing station including intermediate stations.
  • Periodic Rest to Running Staff
  • At least 5 periods of rest of not less than 22 consecutive hours each per month or at least 4 periods of rest of not less than 30 consecutive hours each per month each including a full night shall be given to Running Staff.
  • Hours of work for this purpose shall be calculated from ‘signing on’ to ‘signing off’.
  • Periodic rest shall be given at headquarters.
  • As far as possible it should be given once in 10 days.
  • Rest after duty
  • Based on total duty ‘signing on’ to ‘signing off’ rest after duty shall be given as follows:
  • At headquarters  
    For duty of less than 8 hours 12 hours
    For duty of 8 hours or more 16 hours
    In either case a Running staff shall not be called to go out if rest is under 6 hours except in unavoidable necessity as in case of accidents or breakdowns.  
    At outstation  
    F 8 hours rest for 8 hours running duty or more (staff may sign for rest to the extent of 6 hours if they so desire)  
    • In case of Running staff who are employed on duties which provide for daily rest at headquarters including Shunters, Running staff working in suburban trains, ballast trains, pilots etc. above provision will not apply. These staff will not normally be called for duty before expiry of 10 consecutive hours after completion of previous duty. If however if any such staff is required to work trains out of headquarters and return he will be eligible for rest outstaion and at headquarters.
    • Interval between trips shall be considered as duty if it is equal to or less than 1 hour plus time allowed for train or engine attendance before and after trips.
    • Allowance for Train or engine attendance
    • Engine attendance - 45 minutes before departure from engine shed and 15 minutes after arrival at engine shed except for garret and other special type of engines for which the Railway Administrations may decide. Train attendance - 30 minutes before departure and 30 minutes after arrival. In case of goods trains allowance before departure will be 45 minutes.
